Terms of Service

These Terms explain the rules for using Hayloft, an AI-powered fictional roleplay, storytelling, and character interaction platform operated by Hayloft Technologies LLC.

1. Acceptance of Terms

By creating an account, accessing, or using Hayloft, you agree to these Terms of Service and to the Hayloft Privacy Policy. If you do not agree, do not use the Service.

"Hayloft," "we," "us," and "our" mean Hayloft Technologies LLC. "Service" means the Hayloft website, app, platform, software, features, characters, chats, and related services.

2. Eligibility and Account Responsibility

Hayloft is intended only for users who are 18 years of age or older. You may not create an account or use Hayloft if you are under 18 or if you are prohibited from using the Service under applicable law.

You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account. Notify us at support@hayloftai.com if you believe your account has been compromised.

3. AI-Generated Fictional Roleplay

Hayloft provides fictional AI-generated roleplay, storytelling, and character interaction. Characters are not real, not conscious, not human, and not capable of understanding or feeling. Chats are with AI systems, not real people.

AI outputs may be inaccurate, fictional, inconsistent, offensive, incomplete, or unexpected. Hayloft does not guarantee that AI Output is unique, copyrightable, non-infringing, accurate, safe, or suitable for any purpose.

Hayloft is not medical, legal, financial, therapeutic, emergency, or professional advice. Do not rely on Hayloft for diagnosis, treatment, legal decisions, financial decisions, crisis support, or emergency assistance. If you are in danger or need urgent help, contact emergency services or qualified professionals.

4. User Content and AI Output

"User Content" includes prompts, chats, character cards, character definitions, profile or persona information, images, reports, feedback, public listings, and other content or submissions you provide to Hayloft.

"AI Output" means text, character behavior, scenes, summaries, responses, or other material generated by AI systems based on User Content, character settings, memory/context, safety systems, model behavior, and other Service inputs.

You are responsible for your User Content and for how you use AI Output. You should review AI Output before relying on it, sharing it, publishing it, or using it outside Hayloft.

5. Rights and Licenses

You retain any rights you have in your User Content. By submitting User Content to Hayloft, you grant Hayloft a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, process, display, reproduce, distribute, modify, moderate, analyze, and use that content as needed to operate, provide, secure, debug, moderate, and improve the Service.

If you make a character, bot, profile element, or other content public, you grant Hayloft and other users the right to access, view, interact with, remix where supported, and use that public content inside the Service.

Hayloft does not claim that user-created bots or characters are official, endorsed, sponsored, approved, or affiliated with any rights holder, creator, publisher, studio, celebrity, brand, franchise, or real person.

6. Public Content, Reports, and Moderation

Users may report characters, chats, messages, profiles, or other content using in-app reporting tools where available or by emailing support@hayloftai.com.

Hayloft may review, remove, restrict, hide, reclassify, make private, suspend, terminate, or otherwise moderate content or accounts at our discretion, including when needed for safety, legal compliance, platform rules, support, security, or product integrity.

7. Prohibited Content and Conduct

You may not upload, create, request, publish, distribute, or use Hayloft for content or conduct that is:

  • Illegal, infringing, deceptive, fraudulent, or designed to evade safety systems.
  • Exploitative, abusive, coercive, threatening, hateful, harassing, or doxxing-related.
  • Sexual or sexually suggestive content involving minors, underage characters, or characters presented as under 18.
  • Grooming, trafficking, sexual exploitation, non-consensual sexual content, or sexualized real-person content.
  • Real-person impersonation that misleads users or violates rights of privacy, publicity, or personality.
  • Instructions or encouragement for real-world self-harm, violence, abuse, illegal activity, or dangerous conduct.
  • Content that violates our Community Guidelines, Copyright/IP Policy, or applicable app store platform rules.

8. Subscriptions, Payments, Renewals, and Refunds

Hayloft may offer paid subscriptions or premium features. Subscriptions renew automatically unless canceled before the renewal date. Depending on platform, purchases, renewals, cancellations, billing, taxes, and payment processing may be handled by Apple, Google, Stripe, RevenueCat, or other payment processors.

In the mobile app, Hayloft Premium may be offered as a monthly subscription through the App Store. The app may display a reference price such as $10.99 per month, but the final price, currency, taxes, renewal period, trial terms if any, and billing rules are the terms shown by the applicable checkout screen.

Free accounts may have limits on character generation, message regeneration, rewinds, memory updates, pinned memories, lore/context fixes, or other usage-based features. Free accounts may also see upgrade reminders while chatting. Premium benefits, limits, and availability may change over time.

You are responsible for reviewing the subscription terms, price, renewal period, and cancellation process shown at checkout. Canceling a subscription may stop future renewals but may not automatically refund previous charges.

Refunds are not guaranteed. Refund requests must be reviewed and approved under the policies of the applicable app store, payment processor, and Hayloft. Where Apple or Google processes the purchase, refund requests may need to be submitted directly through that platform.

9. Service Changes and Availability

Hayloft may change, limit, suspend, discontinue, or remove features, models, memory behavior, characters, subscription benefits, rate limits, moderation rules, or access to the Service at any time. We do not guarantee uninterrupted or error-free operation.

10. Termination

You may stop using Hayloft at any time. We may suspend or terminate your account or access to the Service if we believe you violated these Terms, created legal or safety risk, abused the Service, infringed rights, or otherwise harmed users, Hayloft, or third parties.

You may permanently delete your account using the Delete Account tool in the app or contact support@hayloftai.com for help. Account deletion removes or anonymizes account data from active systems, but limited records may remain temporarily in backups, logs, moderation records, legal records, payment records, or security systems. Deleting your account does not automatically cancel an active Apple subscription.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Hayloft disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

12. Limitation of Liability

To the fullest extent permitted by law, Hayloft Technologies LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities, arising from or related to your use of the Service.

To the fullest extent permitted by law, Hayloft's total liability for claims relating to the Service will not exceed the greater of $100 or the amount you paid Hayloft for the Service during the 12 months before the claim arose.

13. Indemnity

You agree to defend, indemnify, and hold harmless Hayloft Technologies LLC and its owners, employees, contractors, and service providers from claims, damages, liabilities, losses, and expenses arising from your User Content, your use of AI Output, your violation of these Terms, or your violation of another person's rights or applicable law.

14. Governing Law and Disputes

These Terms are governed by the laws of Wyoming, United States, without regard to conflict-of-law rules. Unless applicable law requires otherwise, the state or federal courts located in Wyoming will have exclusive jurisdiction and venue for disputes arising from or relating to these Terms or the Service.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the Service or by other reasonable means. Your continued use of Hayloft after changes become effective means you accept the updated Terms.
